    Customer Service Agreement

    Terms & Conditions of Service — Version 2.0

    Thank you for choosing Poo Pickers LLC.

    We believe great service starts with clear expectations. These Terms & Conditions explain how our services work, what you can expect from us, and what we ask from you in return.

    By requesting or scheduling service, enrolling in recurring service, accepting services from Poo Pickers LLC, or electronically accepting these Terms, you agree to the following Customer Service Agreement.

    Article I — Services & Enrollment

    1. Services

    Poo Pickers LLC ("Poo Pickers," "we," "our," or "us") provides residential and commercial pet waste removal and related outdoor pet-care services.

    Services may include:

    • Recurring residential pet waste removal
    • Initial Yard Resets
    • One-time cleanups
    • Commercial pet waste removal
    • HOA and common-area cleanup
    • Dog waste station maintenance
    • Premium waste removal or haul-away
    • Additional services offered by Poo Pickers from time to time

    Service availability depends on location, route capacity, staffing, scheduling, property conditions, weather, safety, and other operational considerations.

    Commercial services may be subject to a separate written service agreement.

    2. Enrollment & Service Availability

    Submitting a quote request, enrollment form, phone inquiry, email, or other request does not guarantee acceptance into service.

    Before recurring service begins, Poo Pickers may require:

    • Acceptance of a service quote
    • Complete and accurate customer information
    • Acceptance of these Terms & Conditions
    • A valid payment method
    • Confirmation that the property is within our service area
    • Available route capacity
    • Final approval by Poo Pickers

    We may decline or postpone service when a property is outside our service area, route capacity is unavailable, access or safety concerns exist, information provided is inaccurate, or accepting the account would interfere with our ability to safely and reliably serve existing customers.

    3. Recurring Service & Route Management

    Poo Pickers operates primarily as a year-round recurring service provider.

    Recurring customers are assigned space within established service routes. These route positions are limited operational resources managed by Poo Pickers and do not guarantee a permanently assigned service day, arrival time, technician, or route position.

    To maintain efficient and dependable service, we may periodically adjust:

    • Service days
    • Route sequencing
    • Technician assignments
    • Estimated arrival windows
    • Geographic route boundaries
    • Customer groupings

    Whenever reasonably practical, we will notify customers of significant scheduling changes.

    Our route-management system allows us to reduce unnecessary travel, maintain dependable schedules, support our technicians, and provide consistent service throughout the communities we serve.

    4. Scheduling & Arrival Times

    Poo Pickers services customers by route rather than by individual appointment time.

    While we make reasonable efforts to maintain consistent schedules, exact arrival times are not guaranteed.

    Arrival times and scheduled service days may be affected by:

    • Traffic
    • Weather
    • Staffing
    • Route changes
    • Vehicle or equipment issues
    • Holidays
    • Emergency circumstances
    • Customer growth
    • Other operational conditions

    Customers may also periodically receive service from different technicians. All Poo Pickers technicians are expected to perform services according to Company standards.

    5. Initial & One-Time Cleanups

    New recurring-service customers are subject to an Initial Yard Reset before recurring service begins. The current Initial Yard Reset fee is $299.99 for Weekly, Biweekly, Once Monthly, and Twice Weekly recurring service, unless different pricing is quoted or approved by Poo Pickers due to property conditions, service requirements, or other circumstances requiring additional labor or manual review.

    The Initial Yard Reset fee is separate from recurring-service charges.

    Initial Yard Reset pricing or service requirements may be adjusted based on factors including:

    • Number of dogs
    • Time since the property was last cleaned
    • Property size or actively serviced yard area
    • Waste accumulation
    • Estimated labor
    • Yard or terrain conditions
    • Access conditions
    • Other factors materially affecting the work required

    Properties involving excessive accumulation, extended periods without cleanup, unusual conditions, or other circumstances materially increasing the required labor may require review and different or custom Initial Yard Reset pricing before service is finalized. An online quoted amount does not override an approved manual review where applicable.

    Loyalty Credit Program

    Poo Pickers may offer Loyalty Credit programs to eligible recurring-service customers from time to time.

    The amount of available credits, qualifying service frequencies, milestone requirements, timing, maximum available credit, and other promotional details will be disclosed to the customer as part of the applicable enrollment offer, quote, promotion, or account communication.

    Unless otherwise stated in the applicable offer, Loyalty Credits:

    • Are issued as invoice or account credits only
    • Are not cash rebates
    • Have no cash value
    • Are not redeemable or transferable for cash
    • Are earned only after the applicable service milestone has been successfully completed
    • Are not an upfront discount of the Initial Yard Reset or recurring-service charges

    To qualify for an applicable Loyalty Credit, the customer's account must satisfy the eligibility requirements disclosed with the offer and generally must remain on an eligible recurring service, active and current, with a valid payment method on file, through the applicable qualifying milestone.

    A pause, cancellation, delinquent account, change to an ineligible service plan, or other loss of eligibility before a milestone is completed may result in the applicable future or unearned credit not being issued.

    Credits already properly earned and applied are not retroactively forfeited unless otherwise permitted by these Terms, the applicable offer, or law.

    Eligibility for one milestone does not guarantee eligibility for future milestones.

    The Loyalty Credit Program available to one customer or at one time does not guarantee that the same offer, amounts, milestones, or eligibility requirements will be available to future customers.

    Poo Pickers may modify or discontinue Loyalty Credit offers for future enrollments at any time. Changes to future promotional offers do not reduce Loyalty Credits already earned by an existing customer under the offer applicable to that customer.

    If a Loyalty Credit promotion is tied to an Initial Yard Reset, credits earned under that promotion may offset a portion of the customer's account charges over time, but such credits are not an upfront reduction of the Initial Yard Reset amount unless expressly stated in the applicable offer.

    One-Time Cleanups

    One-Time Cleanups are separately priced and are not subject to an additional recurring-service Initial Yard Reset fee or the recurring-service Loyalty Credit Program.

    One-Time Cleanup pricing may vary based on property size, number of dogs, waste accumulation, estimated labor, access, terrain, yard conditions, and other factors affecting the work required.

    One-Time Cleanups remain subject to route capacity, staffing, scheduling, seasonal demand, and service-area availability.

    If recurring service is canceled or interrupted for an extended period, another Initial Yard Reset and associated fee may be required before recurring service resumes.

    Article II — Scope of Service

    6. What's Included in Standard Recurring Service

    Unless otherwise agreed or quoted by Poo Pickers, standard residential recurring-service pricing is intended for up to 1/4 acre of actively serviced yard area. "Actively serviced yard area" refers to the portion of the property the dogs regularly use and that Poo Pickers is expected to service, not necessarily the property's total parcel acreage. Properties or actively serviced areas exceeding this standard may require additional review, modified service requirements, or adjusted pricing.

    Unless otherwise agreed in writing, standard recurring pet waste removal generally includes:

    • Systematic inspection of designated service areas
    • Removal of visible pet waste
    • Bagging collected pet waste
    • Secure closure of waste bags
    • Placement of collected waste in the customer's designated on-site waste receptacle
    • Sanitization of Company equipment between properties
    • Service notifications when available

    Poo Pickers uses reasonable care and systematic search procedures during each visit.

    Outdoor conditions can affect visibility and accessibility. Tall grass, leaves, snow, ice, mud, standing water, debris, landscaping, terrain, lighting, vegetation, or other conditions may prevent technicians from locating or safely accessing every piece of pet waste.

    Although our goal is to remove all visible pet waste, absolute perfection under every outdoor condition cannot be guaranteed.

    7. Services Not Included

    Unless specifically included in the customer's selected plan or separately authorized, standard recurring pet waste removal does not include:

    • Landscaping or lawn maintenance
    • Leaf or brush removal
    • Snow or ice removal
    • Weed removal
    • Household trash removal
    • Dead animal or wildlife removal
    • Gate or fence repair
    • Patio, sidewalk, driveway, or deck cleaning
    • Hazardous-material removal
    • Excavating or retrieving buried waste
    • Off-site waste removal
    • Odor treatment or lawn treatment
    • Other services not specifically included in the customer's plan

    Additional or premium services may be available separately.

    8. Waste Disposal

    Unless otherwise agreed, collected pet waste will be securely bagged and placed in the customer's designated on-site trash receptacle.

    Customers are responsible for providing a reasonably accessible and usable receptacle.

    Standard recurring service does not include transporting collected pet waste away from the property.

    Premium waste removal or haul-away may be available for an additional fee.

    9. Changes to Your Property or Service

    Customers agree to notify Poo Pickers when circumstances change in a way that may affect service, including:

    • Adding or removing dogs
    • Changing service areas
    • Installing or modifying fencing
    • Changing gates, locks, combinations, or access instructions
    • Adding pools, structures, play equipment, or landscaping
    • Construction or drainage projects
    • Changes affecting technician access
    • New hazards or safety concerns

    Changes that materially increase the time, labor, or resources required to service the property may result in updated pricing, scheduling, or service requirements. If conditions materially differ from the information provided during online quoting—including the number of dogs regularly using the property, the serviced area, property or access conditions, gate or access information, or dog access—Poo Pickers may review pricing and service requirements before continuing or finalizing service.

    Online quotes are based on the information provided by the customer and reflect standard residential service. Most standard residential properties qualify for the displayed rate; however, large service areas, unusual access, heavy accumulation, five or more dogs, or other non-standard conditions may require a custom quote or review. A displayed online rate is not unconditionally guaranteed where the information provided is inaccurate or the property presents non-standard conditions.

    Article III — Property Access & Safety

    10. Property Access & Gates

    Customers are responsible for providing safe and reasonable access to all designated service areas on scheduled service days.

    Please ensure:

    • Gates are unlocked or approved access instructions are current
    • Entry points are unobstructed
    • Gate codes or combinations are accurate
    • Designated service areas are reasonably accessible

    If we cannot access a service area because of a locked, frozen, damaged, blocked, or otherwise inaccessible gate or entry point, the visit may be skipped or modified.

    Because technician and route time has already been reserved, inaccessible visits may still be subject to the normal service charge.

    Repeated access issues may result in service adjustments or cancellation.

    11. Dogs & Animal Safety

    We love dogs, but the safety of our customers, pets, and technicians comes first.

    Customers are responsible for ensuring pets do not present an unreasonable safety risk during service.

    If a dog or other animal has shown aggression, protectiveness, fearfulness, unpredictability, or other concerning behavior, the customer should securely separate the animal from the service area before our technician arrives.

    If a technician reasonably believes an animal presents a safety risk, the technician may skip, modify, or discontinue the visit.

    When requested or required for safe service, customers are responsible for ensuring dogs cannot access the active service area while the technician is working. Doggy doors or other pet-access points must be closed or secured as necessary before service. Poo Pickers may delay, skip, or reschedule service if safe access cannot be provided.

    A skipped visit resulting from an unsafe animal or inaccessible service area may still be charged.

    12. Hazards & Technician Safety

    Customers agree to disclose known hazards that may not be readily visible, including:

    • Broken glass
    • Exposed metal or wire
    • Construction debris
    • Holes or unstable ground
    • Bee or wasp nests
    • Needles or medical waste
    • Open excavations
    • Flooded areas
    • Hazardous materials
    • Other unsafe conditions

    Poo Pickers technicians are authorized to use reasonable professional judgment when determining whether a property can be safely serviced.

    If conditions create an unreasonable risk of injury or property damage, service may be delayed, modified, skipped, or discontinued.

    No service visit takes priority over the safety of our customers, their pets, or our employees.

    13. Weather & Unavoidable Delays

    Poo Pickers operates in normal outdoor weather whenever reasonably safe.

    Severe or unsafe conditions may delay or prevent service, including:

    • Lightning
    • Flooding
    • Heavy snow
    • Ice
    • Extreme temperatures
    • High winds
    • Dangerous road conditions
    • Other severe weather

    We will make reasonable efforts to resume affected service as operating conditions permit.

    Poo Pickers is not responsible for delays or service failures caused by circumstances reasonably beyond our control, including severe weather, natural disasters, government actions, emergencies, road closures, equipment failures, labor disruptions, fuel shortages, public-health emergencies, or similar events.

    Article IV — Billing & Payments

    14. Billing & Automatic Payments

    Recurring services are generally billed in advance according to the customer's selected service plan.

    By enrolling in recurring service and providing a payment method, the customer authorizes Poo Pickers to process the payment method on file for authorized charges associated with the account, including:

    • Recurring services
    • Initial Yard Resets
    • Approved additional services
    • Applicable taxes
    • Approved additional charges
    • Outstanding balances

    Customers are responsible for maintaining valid and current payment information and reviewing invoices for accuracy.

    Poo Pickers may adjust pricing due to changes in labor, fuel, insurance, equipment, inflation, operating costs, or other legitimate business considerations.

    Whenever reasonably practical, customers will receive advance notice of material pricing changes.

    Prepaid Billing Options

    Poo Pickers may offer customers the option to prepay recurring service for an extended billing period in exchange for a discounted rate.

    Available prepaid periods, discount percentages, prices, eligibility requirements, and other offer details will be disclosed at enrollment or when the customer selects the prepaid billing option.

    A prepaid discount applies only when the applicable billing period is paid in full in advance.

    If a customer cancels before completing a discounted prepaid billing period, any refund that may otherwise be due for unused future service may be recalculated after reconciling the discount associated with the uncompleted prepaid commitment. Services already performed remain earned and non-refundable. Earned charges, outstanding account balances, or other properly due amounts may be deducted from any eligible refund. Any remaining approved refund will be processed according to Poo Pickers' normal refund and payment-processing procedures. A customer who ends a prepaid commitment early is not entitled to retain a promotional discount as though the full prepaid commitment had been completed.

    The Initial Yard Reset, where applicable, is a separate one-time charge and is handled according to the customer's enrollment terms, independent of the recurring prepaid billing option selected.

    15. Failed Payments & Delinquent Accounts

    If payment cannot be successfully processed, Poo Pickers may make reasonable attempts to contact the customer and collect the outstanding balance.

    Service may be suspended or canceled if payment remains unresolved.

    During a suspension:

    • Scheduled services may not be performed
    • The customer's route position may be released
    • Continued service availability cannot be guaranteed

    Reactivation may require:

    • Payment of outstanding balances
    • A valid payment method
    • An Initial Yard Reset
    • Acceptance of current pricing
    • Available route capacity
    • Any applicable reactivation charges

    Reactivation is not guaranteed.

    16. Cancellation, Pauses & Returning Customers

    Customers may discontinue recurring service in accordance with the cancellation procedures communicated by Poo Pickers.

    Canceling or voluntarily interrupting recurring service releases the customer's route position.

    Unless Poo Pickers specifically agrees otherwise in writing, a route position is not reserved during a voluntary service interruption.

    Customers returning later are always welcome to request service; however, reactivation is treated as a new enrollment and may be subject to:

    • Current route capacity
    • Current pricing
    • Current service days
    • Current Company policies
    • Current technician assignments
    • An Initial Yard Reset

    Previous pricing, service days, technicians, or route positions cannot be guaranteed.

    17. Refunds

    Services already performed are generally non-refundable.

    Poo Pickers will investigate suspected billing errors, duplicate charges, or other legitimate billing concerns and correct Company errors when appropriate.

    Refund requests will be evaluated based on the specific facts and circumstances involved.

    Approved refunds will generally be returned to the original payment method when reasonably practicable.

    Nothing in this section limits rights available under applicable law.

    Article V — Service Quality & Conduct

    18. Service Quality & Satisfaction Concerns

    Poo Pickers is committed to professional, consistent service.

    If you believe a service visit did not meet our standards, please contact us as soon as reasonably possible after the visit.

    We may request photographs or additional information to help us understand and evaluate the concern. These requests are intended to help us investigate objectively, improve technician training, and determine an appropriate resolution—not to question a customer's honesty.

    Depending on the circumstances, service recovery may include:

    • Technician coaching
    • Additional training
    • A return service visit
    • A reasonable billing adjustment
    • Other corrective action we determine appropriate

    We ask customers to give us a reasonable opportunity to investigate and address concerns.

    19. Professional & Respectful Conduct

    Poo Pickers employees are expected to treat customers and their property professionally and respectfully.

    We ask customers to extend the same courtesy to our team.

    Constructive feedback and reasonable complaints are always welcome.

    Abusive, threatening, discriminatory, harassing, intimidating, or unsafe behavior toward Company personnel will not be tolerated and may result in suspension or termination of service.

    20. Photos & Service Documentation

    Poo Pickers may take service-related photographs when reasonably necessary for:

    • Gate or access verification
    • Service-completion documentation
    • Quality control
    • Yard-condition documentation
    • Internal records
    • Training
    • Customer support
    • Investigating service concerns

    Poo Pickers will make reasonable efforts to limit service documentation to areas relevant to the work being performed.

    Any use of customer-property photographs for advertising or promotional purposes should be handled in accordance with applicable consent requirements and the Company's Privacy Policy.

    Article VI — Commercial Services

    21. Commercial Services

    Commercial services may include pet waste removal, common-area cleanup, dog-park cleanup, waste-station maintenance, bag restocking, waste-bin servicing, and related services for:

    • Apartment communities
    • Condominium associations
    • HOAs
    • Municipal properties
    • Parks
    • Veterinary facilities
    • Pet-friendly businesses
    • Multi-family properties
    • Other commercial or institutional properties

    Commercial service frequency, pricing, responsibilities, reporting, and other requirements may be governed by a separate written agreement.

    Article VII — Communications & SMS

    22. SMS/Text Messaging Terms

    Poo Pickers may offer SMS/text messaging for service-related and, where separately authorized, promotional communications.

    By affirmatively opting in to receive SMS messages from Poo Pickers LLC, you acknowledge and agree that:

    • You are providing consent to receive SMS/text messages at the mobile number you provided.
    • Message frequency may vary based on your services, account activity, and communication preferences.
    • Message and data rates may apply.
    • You may opt out at any time by replying STOP.
    • For assistance, reply HELP or contact Poo Pickers directly.
    • Consent to receive marketing SMS messages is not a condition of purchasing goods or services.
    • Wireless carriers are not liable for delayed or undelivered messages.

    Messages may include, depending on your enrollment and communication preferences:

    • Appointment or service confirmations
    • Technician arrival or ETA notifications
    • Service-completion notifications
    • Schedule or route changes
    • Weather-related updates
    • Billing or account notifications
    • Customer-support communications
    • Other service-related messages
    • Promotional or marketing messages where separately authorized

    Message frequency varies. Service-related activity may result in additional messages beyond ordinary recurring communications.

    You can cancel SMS messaging at any time by replying STOP. After sending STOP, you may receive a final confirmation that your opt-out request has been processed.

    23. Electronic Communications

    Customers may receive account-related communications through methods authorized by Poo Pickers, including:

    • Email
    • Telephone
    • SMS/text
    • Customer portal
    • Other electronic methods made available by the Company

    Customers are responsible for keeping their contact information accurate and current.

    Electronic notifications are provided using third-party telecommunications and technology systems. Delivery cannot be guaranteed in every circumstance.

    SMS communications remain subject to the opt-in and opt-out provisions described in Section 22.

    24. Age Requirement

    Customers must be at least 18 years old to enter into this Agreement, enroll in service, provide payment authorization, or opt into SMS communications.

    By enrolling in service, you represent that you are at least 18 years of age and legally capable of entering into this Agreement.

    Article VIII — Privacy & Website Use

    25. Privacy & Customer Information

    Poo Pickers collects and uses customer information as necessary to provide services, process payments, communicate with customers, maintain accounts, operate our website and systems, and support legitimate business operations.

    Use of personal information is also governed by the Company's Privacy Policy.

    Customers should review the Privacy Policy for additional information regarding the collection, use, sharing, and protection of personal information.

    26. Website Use

    Customers and website visitors agree to use Poo Pickers' website, forms, customer portals, and communication channels only for lawful purposes.

    Users may not knowingly:

    • Submit fraudulent or intentionally false information
    • Attempt to interfere with website or Company systems
    • Misuse forms or communication channels
    • Attempt unauthorized access to Company systems or accounts
    • Use Company services in violation of applicable law

    Article IX — Liability & Service Rights

    27. Property Damage & Limitations

    Poo Pickers will exercise reasonable care while performing services.

    Customers should promptly report suspected damage associated with a service visit so the Company has a reasonable opportunity to investigate.

    Poo Pickers is not responsible for pre-existing defects or conditions outside its reasonable control, including defective gates, broken fencing, damaged latches, hidden hazards, unsafe structures, inaccurate access instructions, or other undisclosed property conditions.

    To the extent permitted by applicable law, Poo Pickers shall not be liable for indirect, incidental, special, punitive, or consequential damages arising from services provided under this Agreement.

    Nothing in this Agreement excludes or limits liability where such exclusion or limitation is prohibited by applicable law.

    28. Right to Refuse, Suspend or Discontinue Service

    Poo Pickers reserves the right to decline, suspend, modify, or discontinue service when reasonably necessary.

    Reasons may include:

    • Unsafe property conditions
    • Aggressive or unsafe animals
    • Repeated access problems
    • Repeated payment failures
    • Fraudulent or materially inaccurate information
    • Abusive or threatening conduct
    • Repeated violations of these Terms
    • Properties outside the service area
    • Insufficient route capacity
    • Conditions making service impractical or unsafe

    When reasonably practical, Poo Pickers will communicate with the customer regarding the reason for suspension or termination.

    Article X — General Legal Provisions

    29. Changes to These Terms

    Poo Pickers may revise these Terms & Conditions from time to time to reflect changes in operations, technology, pricing policies, safety practices, applicable laws, or customer-service procedures.

    Whenever reasonably practical, customers will receive notice of material changes affecting recurring services.

    The current version of these Terms will be made available through the Company's website, customer portal, or upon request.

    Continued use of services following the effective date of revised Terms constitutes acceptance to the extent permitted by applicable law.

    30. Electronic Acceptance

    This Agreement may be presented and accepted electronically through the Poo Pickers website, enrollment forms, customer portal, or other electronic systems.

    By selecting an acceptance checkbox or otherwise completing an electronic acceptance process, the customer acknowledges that they have had access to these Terms and agree to be bound by them.

    Electronic acceptance is intended to have the same effect as a handwritten signature to the fullest extent permitted by applicable law.

    31. Governing Law

    This Agreement is governed by and interpreted in accordance with the laws of the State of Ohio, without regard to conflict-of-law principles.

    32. Severability

    If any provision of this Agreement is determined to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions will remain in effect.

    To the extent permitted by law, an invalid or unenforceable provision may be interpreted or modified as necessary to most closely reflect its intended purpose while remaining enforceable.

    33. Entire Agreement & Waiver

    This Customer Service Agreement constitutes the agreement between Poo Pickers LLC and the customer regarding the services covered by it, together with any separate written service documents expressly incorporated into the agreement.

    Failure by Poo Pickers to enforce a provision on one occasion does not waive its right to enforce that provision later.

    Section headings are provided for convenience and do not alter the meaning of the Agreement.
